As you review this language with your attorney, he or she may want to know the following: that our legal name is “Maryville Academy”, that we are an Illinois not-for-profit corporation located in Des Plaines, Illinois and that our FEIN is 36-2170873. We will be happy to provide you or your attorney with our tax-exempt letter upon request.
Unrestricted Bequest
"I hereby give and bequeath to Maryville Academy of Des Plaines, an Illinois not-for-profit corporation, located in Des Plaines, Illinois, [the sum of __________ dollars] [the following described property: [___________] [ ________ % of the residue of my estate] to be used for its general charitable purposes."
Restricted Bequest
"I hereby give and bequeath to Maryville Academy, an Illinois not-for-profit corporation, located in Des Plaines, Illinois, [__________% of the residue of my estate][the sum of __________ dollars] [the following described property:(___________)] to be used for ___________________ (state particular department, program or other purpose). In the event that the (name of particular department, program or other purpose) shall be renamed, merge with another department or program at Maryville or shall cease to exist altogether, the Executive Director of Maryville, in his or her sole discretion, shall determine the proper allocation of the Fund assets within Maryville, taking into consideration the testator’s/grantor’s intent as set forth herein.”
Contingent Bequest
"In the event that none of the beneficiaries named above is living or in existence on the date of my death, I hereby give and bequeath all of the rest, residue and remainder of my estate, both real and personal, to Maryville Academy, an Illinois not-for-profit corporation, located in Des Plaines, Illinois, to be used for its general charitable purposes OR to be used ___________________ (state particular department, program or other purpose). In the event that the (name of particular department, program or other purpose) shall be renamed, merge with another department or program at Maryville or shall cease to exist altogether, the Executive Director of Maryville, in his or her sole discretion, shall determine the proper allocation of the Fund assets within Maryville, taking into consideration the testator’s/grantor’s intent as set forth herein.”
